1. Acceptance of Terms

By accessing or using the Ufondu Holdings LLC d/b/a Ufondu Kitchen website (“Site”), placing an order, or using any of our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our Site or services.

2. Pricing & Payment Transparency

A 3.0% Cash Discount is available for customers who pay with cash in person for pickup and dine-in orders only. This discount is not available for delivery orders. The cash-discounted total is displayed at checkout when you select the Cash payment option.

Prices are listed in U.S. Dollars (USD) and include only the base price of menu items. Applicable taxes are calculated and displayed at checkout before you complete your order. We reserve the right to change menu prices at any time without prior notice; however, any price change will not affect orders already confirmed.

3. Delivery Fees & Service Charges

Delivery orders are fulfilled through DoorDash Drive. Delivery fees are determined by DoorDash based on distance and demand, and are clearly displayed before you finalize your order. You will see the exact delivery fee and estimated delivery time on the checkout page before completing your purchase. No hidden fees or service charges will be added after the order summary is presented.

Delivery is available only within the service area supported by DoorDash Drive from our location. Delivery orders require card payment — cash and Zelle are not accepted for deliveries.

4. Order Acceptance & Availability

All orders placed through the Site are subject to acceptance by Ufondu Kitchen. We may decline or cancel orders due to ingredient unavailability, kitchen capacity, operating hours, or suspected fraudulent activity. If your order is cancelled after payment has been processed, you will receive a full refund.

Menu item availability is managed in real-time. Items may be temporarily unavailable if key ingredients fall below required stock levels.

5. User Accounts

You may create an account using your email and password or through Google Sign-In. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

6. Third-Party Platforms & Links

Ufondu Kitchen may also be available on third-party ordering platforms such as UberEats, Grubhub, and DoorDash, integrated via Deliverect. Orders placed through these platforms are governed by their own terms and conditions, pricing, and refund policies, which may differ from ours. We are not responsible for pricing, fees, or disputes arising from orders placed on third-party platforms.

Our Site may contain links to third-party websites. We do not endorse or control these sites and are not liable for their content, privacy practices, or terms.

7. Intellectual Property

All content on this Site — including text, images, logos, recipes, and design elements — is the property of Ufondu Kitchen or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

8. Limitation of Liability

To the fullest extent permitted by New York law, Ufondu Kitchen shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or consumption of our food products. Our total liability shall not exceed the amount paid for the specific order in question.

9. Allergen & Dietary Disclaimer

Our kitchen prepares food using a variety of ingredients including nuts, shellfish, gluten, dairy, and soy. While we take precautions, we cannot guarantee that any item is completely free from allergens due to shared kitchen equipment. Customers with severe allergies should exercise caution and communicate their needs to our staff.

10. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Albany County, New York.

11. Changes to These Terms

We reserve the right to modify these Terms & Conditions at any time. Changes take effect upon posting to this page. Continued use of the Site after changes constitutes acceptance of the updated terms.

13. SMS/Text Messaging Terms

By providing your mobile phone number, you opt in and agree to receive transactional and automated service text messages from Ufondu Kitchen. Message frequency varies based on your interactions.
